I had a few observations on Bava Batra pg 26. One observation is 10 saplings for a 50 cubit by 50 cubits parcel of land. How do you divide it? I think you divide the 50 by 50 space into 10 equal parts, and then place each sapling in each square, and you don’t worry if one sapling is closer to another, while another sapping is further. I also noted Rambam Bikirum chapter 2 law 11 where he decided the law like Rabin in the name of R Yochanan that if one owns a tree that is next to the border of his neighbor, he still can bring first fruits from it even though he has to remove the tree from that place. One can asks from Laws of Neighbors (chapter ten starting at law five). He writes you can place a tree next to the border because it is upon the one being damaged to remove his own property (as the law is to R Jose). Also, Rav Shmuel Rozovski (the rosh yeshiva of Ponovitch) held the reason Ula said one who has a tree within 16 cubits of the border of his neighbor cannot bring first fruits is that he goes by the idea that the roots are the main part of the tree. Since they are the main thing, and they are in an area that is not of the owner of the tree the owner cannot repeat the line in the paragraph of first fruit your land. That might be so to Ula, but we do not decide the law that way as we can see here that the law is like Rabin in the name of R. Yochanan and the reason is probably based on the idea behind the law in the Rambam in Trumot chapter 1 law 24 that if a tree is in Israel but its branches outside or if it is outside and its branches in Israel everything goes by where the main tree is, as I saw this brought in the Avi Ezri of Rav Shach. We see we make no difference between the tree and its roots. Rather we make a difference between the truck of the tree and its branches, and we go by the truck of the tree.-

Since they are the main thing, and they are in an area that is not of the owner of the tree the owner cannot repeat the line in the paragraph of first fruits, "your land". That must be so to עולא, but we do not decide the law that way, as we can see here that the law is like רבין in the name of ר’ יוחנן and the reason is probably based on the idea behind the law in the רמב’’ם in תרומות chapter א' law כ''ד that if a tree is in Israel, but its branches outside, or if it is outside and its branches in Israel, everything goes by where the main tree is, as I saw this brought in the Avi Ezri of Rav Shach.
