I missed learning by the Litvaks in the morning and had to go to the sea, on the way back I was thinking about Rav Shach’s explanation of the argument between the Ramban (Nachmanides) and R Nisim (the Ran) in Shavuot page 43. [This argument is brought in the Rif.] What I think now is this. I think R Nisim (the Ran) holds the law is like R Yochanan in terms of eiravon (guarantee of a sale) because that is on what R Yochanan said his law. But we also know that the Rambam (Maimonides) does not hold with the law of Shmuel that if one has borrowed money and given a guarantee and it is lost, the whole loan is nullified. So, R Nisim we can understand perfectly well. An eiravon is for a sale, and there the law is like R Yochanan that the guarantee (eiravon) is for the whole sale. If the eiravon is lost, the whole sale is nullified. A mashkon is for a loan, and in that case, if the guarantee (mashkon) is lost, the amount of the loan that was more than the worth of value of the mashkon is still obligated. The Ramban (Nachmanides) however holds that the law of R Yochanan applies also to a mashkon. So now we can understand the argument between the Ramban and R. Nisim (the Ran). The Ramban (Nachmanides) wrote that if one borrowed money and received a guarantee and lost the mashkon, the borrower does not have to pay back anything. R Nisim disagrees and says that the amount of the loan that was worth more than the mashkon is still owed. Rav Shach says this depends on the argument between R Yochanan and Rav. However, I think R. Nisim (the Ran) holds that (in terms of a loan), the mashkon covers only its exact worth, not the whole loan. (R Yochanan said the guarantee goes for the whole debt only in the case of a sale, not loan. The case in Bava Metzia where he is brought is talking about a sale.) I think he has a good reason for this because even the Rambam who holds like R Yochanan does not hold that the guarantee goes for the whole loan as we see that he does not decide the Shmuel. However, R Nisim (the Ran) would have to agree that the law is like R Yochanan in a case of a sale because it is a general rule that when there is a disagreement between Rav and R Yochanan, the law is like R Yochanan. Now even though the Gemara in Bava Metzia 48 holds the mashkon and eiravon are the same in terms of law, the Rambam (Maimonides) does not need to agree with that because, in any case, that Gemara is going like Shmuel who the Rambam holds is not according to the law. But I am saying all this only according to R Nisim. The Ramban (Nachmanides) however, holds the mashkon and eiravon are the same, and in terms of both, the law is like R Yochanan [which would be like Shmuel.]

I suggest in my previous blog entry how Rav Shach might be explaining the Rambam in meila . However, it occurred to me on my way back from the sea to ask on this. In other words, my answer might be differentp that that of Rav Shach. The reason I say this is that he brings the Baal Hameor for a different reason than I do. He brings him because the Baal Hameor requires that both the money and bought object be in existence at the time of nullification of the sale. But that approach does not help at first for the reason that we are looking for a reason that if a Jew buys an object from another Jew without picking it up, he does not transgress meila because of the decree that” picking up acquires” unless both objects are around. If both the money and object are around, then money acquires according to the Baal Hameor, and therefore the buyer should be considered to transgress. [However, it is clear that Rav Shach intends to say that since the sale is not final, then there is no meila.] Rav Shach is thinking that it is not enough that the sale is now valid from the Torah because money acquires, but that we also need the buyer to benefit from the sale. This seems shaky to me. If he acquires the object, that would seem to mean that he gained benefit even if he can nullify the sale until he picks up the object.] At any rate, there are more questions that came shooting at me on my way back from the sea and i doubt if I can remember them all. That is the idea of the Baal Hameeor and the Ramban that the decree that pulling acquires is only for the seller and buyer. The Sages would not have made a decree for a gentile. Therefore, when the Jew pays with money of hekdesh (the Temple) to a gentile (without picking up the bought object) he transgresses meila because the gentile has acquired the money regardless if the Jew has acquired the bought object or not. You do not need the idea of the Maharam of Lublin that the decree of the sages was only that the buyer does not acquire until he picked up the bought object, but that that the seller does not acquire the money. I think that idea does not solve the Rambam in any case, because if it would be so, then what about the case when the Jew buys from another Jew? I tried to understand what Rav Shach and Reb Aaron Kotler are saying about the subject in Bava Metzia page 48. I cannot say I understand either. However, on the way back from the sea, it occurred to me what I think Rav Shach is saying. But when the Jew buys from another Jew, and pays with money of hekdesh (without picking up the object), he does not transgress meila. Rav Shach asks on this, and I think he is asking that even when the Jew buys from another Jew, he should transgress the prohibition because from the law of the Torah money acquires. Now this is what I think about this. The decision of the Rambam is no problem because it is directly from the gemara in Avoda Zara page 63. If one pays with a sheep to a prostitute that is a gentile, she acquire it even before she picks it up because money acquires, and the sex is in place of the money that pays for the sheep. This can also be considered to come directly from the Gemara in Bava Metzia page 48 because the braita that Rava brings as support to Reish Lakish can easily be thought to refer to a gentile as Tosphot writes there.(Rava is based on how Rav understands the braita, that that it means only paying for entry to a bathhouse with money of hekdesh transgresses meila. However, R Yochanan can say the braita is just one example of the law that money acquires.) The only question is what is the reasoning behind all this. According to the Baal Hameor the law that a Jew acquires by means of pulling is for the benefit of the seller. The Ramban disagrees and hold it is for the benefit of both. But in either case it is for the benefit of the parties involved. Therefore, in the case where a Jew buys an object from a gentile, there is no decree of the sages for the benefit of the gentile. Just for background information. The Rambam decided that a gentile can acquire by means of picking up or by money. Picking up comes from the gemara in Avoda Zara page 71a where Ameimar said a gentile acquires by pulling. [This is against Rav Ashi there.] The Rambam also decided like the gemara Avoda Zara page 63 where giving a sheep to a gentile prostitute it becomes the payment of a prostitute. [The sheep is used as money to pay for the sex.] See the Gra in Shulchan Aruch Choshen Mishpat chapter 194, Paragraph 10 in the notes of the Gra.]

I noticed the answer of the Or Sameach who tries to answer the question on the Rambam chapter 6 law 10 of Meila. The Or Sameach rightly sees that the Rambam never mention meila in terms of change of domain. He brings it only concerning gaining benefit of hekdesh or damaging the value of hekdeh. Thus, when the Rambam says a Jew that buys an object from another Jew with money of hekdesh, but does not pick up the object, he does not commit meila, that is because the Jew’s acquisition is not valid since the sages held that money acquires from the law of the Torah, but there is a decree that one also needs to pick up the acquired object. The problem with this answer is that it should applies as well to the case where a Jew buys from a gentile, which it does not. Therefore, you have to say that the Rambam depended on the the Mishna (and braita) that say if one uses money of hekdesh to gain entrance to a bathhouse, he transgresses meila. Rava said that is a proof to Reish Lakish, but only because of how Rav explained them. But R Yochanan can simply say that braita is just one example of how one can transgress meila. That is by using money of hekesh to pay a gentile.but a proof to the law that the Rambam writes is in avoda zara pg 63 where the gemara makes clear that if one gives a sheep to pay for sex with a zona that is a non Jew, that sheep is an etnan. That means it is included in the prohibition of bringing an animal sacrifice that is the payment of a prostitute. That means the sheep was in fact acquired by the prostitute. R Yochanan said that according to the law of the Torah money acquires. However, because of the worry that the seller might say to the buyer your wheat was burned up in my attic the sages decreed that pulling or picking up acquire. He says the decree of pulling or picking up was to remove the possible problem of the original owner ignoring the wheat being burnt up after that it has been acquired by the buyer. The Baal Hameor says that if the wheat has been burnt up then neither can renege on the sale. The whole purpose of the law was to ensure that the owner or the buyer can nullify the deal until picking up of the object. But neither can nullify the deal unless both the money and the object still exist. I am having trouble understanding this. The sages did not want the sale to be nullified after it has been completed. Only they changed the time of completion to a later time. Why not just say which ever comes later completes the sale, either the money or the piking up of the object. So, leave the law of the Torah in its place, and say that even after acquisition by money, each can renege on the sale unless the wheat has been burnt. I was again the local beit midrash that goes by the path of the Gra, (the Gaon of Villna), and looked again at the subject of money acquires. Then I went to the sea, and thought about the answer I gave yesterday, and when I came back from the sea, it occurred to me to expand on what Rav Shach answers. For the way I explained it yesterday, seems to me now to be lacking a bit of clarity. For the major question what in Rambam, laws of meila, chapter 6 law 10, where if a Jew buys from another Jew with money of hekdesh [without picking up the object], he is not liable for meila.] The way to answer this question does not seem to be answerable by the opinion of the Hameor (that the sages hold money acquires). That just makes the question stronger. At least with the Rif, we can say the sages nullified acquisition by money completely until there is picking up of the object. So, at this point, we have to come to a more complete answer for the Rambam. And that answer has to be based of several Gemaras, one about the bathhouse where the Gemara itself makes a distinction between bathhouse keeper that is a Jew or a gentile; and the case in Avoda Zara pg. 63 of the payment to a prostitute where again there is this same distinction. Therefore, the Rambam has a perfectly good reason to make this distinction. All that is left is to find a reasonable explanation to justify it. And that is not easy to find. If it is just a matter of being able to renege on the deal, then why when the Jew buys from the gentile he is liable, even though the deal can be broken by either party. It seems to me that the Rambam might be thinking that a decree of the sages cannot apply to gentiles. So, when the Jew buys from the gentile, we go by the law of the Torah that the Jew is liable for meila. i was puzzling over what Rav Shach says about the law that physical money acquires by the law of the Torah, but there was a worry that the seller might leave the acquired object to be burnt and thus not be required to pay back the money given to him by the buyer. I looked that the gemara Bava Metzia page 48 and the gemara Avoda Zara page 71 and 63 and still had zero idea what is going on. I went to dip in the sea, and on the way back it occurred to me what Rav Shach might be saying. I think he intends to ask this: the Rambam wrote that a Jew that buys an object from a gentile, and gives him money of hekdesh (that belongs to the Temple), but has not picked up the object, the Jew has committed the sin of using that which belongs to the Temple for a secular purpose (meila). However, if the Jew buys from another Jew with money of hekdesh, but has not yet picked up the object, he has not committed meila until he picks up the object. I think Rav Shach finds this difficult because picking up is a decree of the sages, and yet by the law of the Torah, money acquires. So, the Jew should be liable for meila immediately when he pays with money of hekdesh (even when he buys from another Jew). I think Rav Shach at first wants to answer this based on the approach of the Baal Hameor. The Baal Hameor hold the sages did not nullify acquisition by money. If a Jew buys an object from a gentile with money (but without picking up the object) of hekdesh [that belongs to the temple] he transgresses the prohibition of meila, [the prohibition of using things for secular purposes that have been consecrated to the temple (chapter 6, law 10 in Laws of Meila in the Rambam). This is a surprize since the law is like R. Yochanan that money or coins cause acquisition by the law of the Torah, but the sages nullified that as far as Jews are concerned, and held that only picking up or pulling the object causes acquisition. What is therefore a surprise in this law is that the Jew has physically given the money, but that money has not acquired anything, since as far as a Jew is concerned, only picking up the object causes acquisition. This is just my first thought about this subject, but I realize there is a tremendous amount of work I need to do in tractate Bava Metzia page 47 to 48 and tractate Avoda Zara page 63. I have tried for a few days to go to the local Litvack Beit Midrash [study hall that follows the Gra and Rav Shach] in my area to learn this subject, but I have barely scratched the surface. But on second thought, it occurs to me that the Rambam does not hold with change of domain in terms of melia, only gaining benefit. (This was pointed out by the Or Sameach chapter 6 in laws of meila, the Keren Ora and Rav Shach ) So, the fact that the money has changed hands (even if it did not acquire anything) might be enough to liable for meila. Maybe. [Tosphot holds with change of domain, not the Rambam.] That is to say that since the Jew has given the money to the gentile, he can now pick up the object that he has bought. So, even though he has not yet acquired it, the fact that he can pick it up might be considered as deriving benefit from the money, and thus be liable for meila.

I got to the sea, and then on the way back, it suddenly occurred to me how to answer a question in the Rambam in a way that is close to what Rav Shach says. [Laws of robbery and Lost Objects 13:17] The idea that occurred to me is this. When a person is guarding a lost object, he is a paid guard. But if the object will lose all its value if it is kept around too long a time, the guard must sell it, and guard the price of the sale. Therefore, he is a borrower, not a paid guard. There should be no ambiguity about this since guarding a lost object is not the same as guarding the money someone paid for it. While often we say what is worth money is money, still that is not universal, and we usually require a special verse to show us this. [See the beginning of Kidushin, and the sugia of paying double for theft where this is an argument.] And the fact that The Rambam holds the guard becomes a borrower is no problem in itself. After all, he is just quoting R Yose in Bava Metzia page 28b] who says if the money of the sale is lost with a by an unavoidable accident, he must pay for it like the law of a borrower, not a paid guard. The only question is why is he not a borrower of money instead of a borrower of an object? And the answer I think is this. The lender did not lend him anything. Rather he lost an object, and the sages instituted this law of selling the object, and being allowed to use the money. That is a borrower of an object, not a borrower of money. How can you be a borrower, if there is no lender? Besides that, the statement the value of money is like money means an object can be used instead (in place of) of money, not the money can be used instead of the object. I said this idea to Rav Brodi (a rosh kollel in Netanya) and he asked, “What would be the law if there was no permission to use the money of the lost object?” His point is that he still has an obligation to guard the money as if it was the lost object itself. I countered this argument by mentioning that that would be the opinion of R Akiva who disagrees with R Jose, and holds the finder cannot use the money. So, it would be the opinion of R Jose that he can use the money, and he becomes a borrower right away even before he uses the money. However, I realize that this objection of Rav Brodi might be the reason that Rav Shach found a different answer for the Rambam.
However, Rav Shach answers that he is liable because the Torah places a obligation on him to guard the lost object and so there is a higher degree of responsibility by the permission to use the money that is it was a case of a deposit.

I was thinking about the Gemara Bava Metzia page 43a on my way back from the sea, and it occurred to me a question that the Rambam decided the law like Rav Huna in terms of lost objects but like Rav Nachman in terms regular deposits. I mean to say that in terms of regular deposits , if a person gives unsealed money to a friend to guard for him, the friend is a paid guard (not a borrower) until he uses the money. Chapter 7 law 6 in borrowing and deposits. In terms of lost objects, if one has a lost object that will deteriorate in time until the owner can pick it up, then the finder sells it, and saves the money in expectation that the owner will pick up the money someday. In the meantime, he can use the money as a borrower. There, the Rambam decided the law is that he is a borrower even before he uses the money. In terms of hedesh, if one gives unsealed hedesh to a money changer, not the depositer nor the money changer are liable for meila, unlike either Rav Nachman nor Rav Huna in Bava Metzia page 43. The question is that in one place the Rambam decided like Rav Huna, then in another place he decided like his opposite, Rav Nachman and in a third place he decided like neither. I was looking at the Gemara Bava Metzia page 43a and then I went to the sea shore, and on the way back, it occurred to me that there is what I think should be a question, but I do not remember seeing anyone asking it. The question is based on the Mishna on page 42, that says : If a person gives his own money (that is not sealed) for safekeeping to a money changer, the money changer can use the money. Therefore, if it is lost in an unavoidable accident, the money changer is liable. Rav Huna holds that he is liable immediately when it comes into his domain because the permission to use it makes him into a borrower, not just a paid guard. [If he would be like a paid guard, he would not be liable for large accidents.] Rav Nachman said the money changer is not liable until he uses the money. The problem that occurred to me if from Bava Metzia 99. Rav Huna said about an axe of hedesh that the gizbar loaned to him by accident, ''If he chopped wood with it, he is liable for meila, if not, not. The question is clear. A hirer of an animal loans out the animal to a borrower and it dies, (Bava Metzia page 35b). The sages say the hirer takes an oath that it was not his fault, and the borrower pays the hirer. R Jose disagrees, and asks how can the hirer make business with someone else's animal? There are two ways of understanding this. Tosphot on the page says the argument is the same one as brought later in the Gemara. [Rav Adi bar Abin asked on the sages, "Why not just have the hirer tell the renter, 'Let us delete your oath, and I will deal with the borrower directly.'" Abye answered him the oath is not what causes the transfer but the death of the animal.] When does the transfer of responsibility happen, at the time of the oath or of the moment the animal died? (The Ran (on the Rif) and other Rishonim disagree.) Rav Shach brings the idea of Reb Aaron Kotler that a claim of an unforeseen accident is not a valid claim, but also shows how it can be considered a valid claim and that both R Yose, and the sages might agree with this. To rav shach this is the argument between R Yose and the sages. Thus, To the sages, we start off with the assumption that the claim of and unforeseen accident is valid. In the days of Isar Meltzer someone found an ancient copy of the commentary of the Ramban and in the first published edition of it, Rav Meltzar wrote comments. But, in those comments he holds a free guard pays the damaged person, i.e., a guard loses the animal he was guarding and it goes and caauses damage. To whom does the guard pay, or to anyone? Maybe just the owner of the animal pays for the damage?) Rav Shach wrote to him showing that the Ramban wrote two different approaches, one on page 36 and the other on page 93. In one approach the guard pays the owner of the animal and he pays the damaged person. In the other approach he pays the damaged person. To me this is hard to understand because we do not see anywhere that if the animal he is guarding causes damage that the guard is obligated at all. If the whole responsibility is a minimum guarding, then that is that. Even if the animal does causes damage, and the owner of the animal has to pay for those damages, we do not see anywhere that the free guard pays anything.---- Be that as it may be, I would like here to explain these two approaches of the Ramban in this way. (It might have depended on if the court says any guard has to guard from the possibility that the animal might go out an cause damage, but I do not think that is what the Ramban intends.) Rather, if after the fact, if the animal has in fact gone and caused damage, then we say retroactively that he should have done maximum guarding. We see this in the braita in Bava Kama page 45 that says if an animal that a free guard is guarding goes and kills someone, he pays kofer (restitution), but not the value of the animal to the owner. If he had been required from the start to guard from this possibility, then he would have been required to do maximum guarding, and therefore would anyway be obligated to the owner of the animal to pay for it. בבא קמא דף כ''ב, ר' יוחנן טוען שאחריות על היזק של אש היא בגלל חיציו. אבל לריש לקיש אש מחויבת בנזקים משום ממונו. האם חובת שמירת בעל חי כדי שלא ייצא ויגרום נזק היא על האדם שבתחום שלו נמצא בעל החי ובאחריותו (שומר), או שמא חובה זו על הבעלים? אם זה על הבעלים כנראה שזאת שיטת ריש לקיש. יש ברייתא בבבא קמא דף מ''ה שאומרת שיש ארבעה סוגי שומרים, שומר חינם, שומר שכר, שוכר, ושואל. אם בעל החי הולך והורג מישהו, כולם צריכים להביא את הכופר והבעל חי נהרג, והשומרים משלמים את עלות בעל החי לבעלים. עם זאת, השומר חינם אינו חייב לשלם לבעלים את עלות בעל החי משום שהוא עשה את חובת השמירה שלו. הגמרא שם אומרת שהמקרה הוא שבו כל אחד שמר על החיה עם המינימום שמירה פחותה. אם הייתה חובה על השומר חינם לשלם פיצויים לניזק (מכיוון שהחיה הייתה ברשותו ובאחריותו), אז הוא לא היה פטור מעלות החיה. אלא, אנו רואים שהבעלים הוא זה שמשלם פיצויים [כמו ריש לקיש, והאחריות לפיצויים היא על הבעלים, לא האדם ששומר על החיה כפי שברור ברמב"ם עצמו בתחילת ה' ניזקי ממון וזה לשונו, "כל נפש חיה שהיא ברשותו של אדם שהיזיקה הבעלים חייבין לשלם שהרי ממונם הזיק." אבל יש להקשות על זה בגלל שהרמב''ם פסק כר' יוחנן. וצ''ל כמו הגר''א שר' יוחנן גם מסכים עם ריש לקיש.]. ההיגיון כאן הוא שאם המקרה לא היה של הריגה, אלא של החיה שגורמת נזק, ולשומר חינם הייתה חובה כלפי אנשים שהחיה גרמה להם נזק, אז הוא היה נדרש לעשות המקסימלית שמירה מעולה כמו שאר השומרים. ואז היה חייב גם לשלם עלות החיה. אלא מכאן רואים שהחיוב שמירה על הבעלים
In Bava Kama page 22 R. Yochanan holds the liability of fire is because of his arrows. But to Reish Lakish fire is obligated in damages it belongs to him. Neither say openly whether the obligation of guarding an animal so that it will not go out and cause damage is on the person in whose domain the animal is, or the owner. But a braita in Bava Kama page 45 says there are four types of guards, free, for pay, a renter, and a borrower. If the animal goes and kills someone, they all have to bring the kofer [restitution] and the animal is killed, and the guards pay the cost of the animal to the owner. However, the unpaid guard does not have to pay the owner for the cost of the animal because he did his obligation of guardianship. The gemara there says the case is where each one guarded the animal with minimum confinement. If the there would be an obligation on the unpaid guard to pay damages because the animal was in his domain and guardianship, then he would not be exempt from the cost of the animal. Rather, we see it is the owner who pays damages [like Reish Lakish, and the liability of damages is on the owner, not the person guarding the animal as is clear in the Rambam himself in the beginning of law of damages ] The other guards would pay back the owner, but not the unpaid guard.
