סוגיית משכון. פסחים ל''א ע''ב. בבא מציעא מ''ח ע''ב. בבא מציעא המשנה בדף פ' ע''ב והגמרא דף פ''ב

פסחים דף ל''א ע''ב. הגמרא מציע שר' עקיבא ור' אליעזר חלוקים בדין של ר' יצחק. עכשיו, ר' עקיבא מחזיק שמלווה עם משכון הוא שומר בתשלום (שומר שכר). ר' אליעזר סבור שהוא שומר ללא תשלום (שומר חינם). תוספות אומרים שמשמעות ר' עקיבא היא כמו ר' יצחק. אולם רש''י מסביר את ר' יצחק שהמלווה עם המשכון הוא שואל. כלומר הדרך היחידה להסביר את הגמרא היא לומר שזה אומר שר' עקיבא ור' אליעזר חולקים שניהם עם ר' יצחק. אגב, אני מציע הסבר אחד לר' יצחק. אולי הוא מתכוון שהמלווה עם המשכון הוא בעלים גמורים. לכן, כאשר הלווה בא להחזיר את ההלוואה, למלווה אין חובה לקבל את הכסף. אם הוא רוצה, הוא יכול להחזיק את המשכון שכן אחרי הכל, הוא שלו--------אבל ממה שאני זוכר, לא כך הגמרא מבין את ר' יצחק ואני חושב שהסיבה היא שהמשכון מעולם לא ניתן מתוך הבנה שהמלווה יוכל לשמור אותו לנצח. לא תחמוד כל אשר לרעיך
Pesachim page 31b. The Gemara suggests that R Akiva and R. Eliezer disagree about the law of R Isaac. R Akiva holds a lender with a pledge is a paid guard. R Eliezer holds he is an unpaid guard. Tosphot say that means R Akiva is like R Isaac. However, Rashi explains R Isaac to mean the lender with the pledge is a borrower. That means the only way to explain that Gemara is to say that it means that R Akiva and R Eliezer both disagree with R Isaac. Incidentally, I think that one explanation of R Isaac has not been offered by anyone, but it seems to me to be possibly what he meant. Perhaps he means that the lender with the pledge owns the pledge. So, when the borrower come to pay back the loan, the lender has no obligation to receive the money. אני רואה באבי עזרי של רב שך שהוא משווה משכון ועירבון, ויש לו סיבה טובה לעשות זאת מאחר והגמרא עצמה (בבא מציעא מ''ח ע''ב) שואלת מאחד לשני ומזה משתמע שהם זהים. אולם משכון הוא ערבות להלוואה ועירבון ערובה למכירה, והרמב''ם אינו משווה אותן. העירבון מבטיח את כל המכירה כמו שאמר ר' יוחנן בבא מציעא דף מ''ח. משכון מיועד להלוואה או להתחייבויות אחרות. שם המשכון מבטיח רק את הסכום המקביל לערכו (לפי הלכות מלווה ולווה פרק 13 הלכה 4)
I see in the Avi Ezri of Rav Shach that he equates mashkon and eravon, and he has good reason to do so since the Gemara itself (bava metzia page 48) asks from one to the other and that implies that they are the same. However, the case of mashkon is a guarantee for a loan and eravon is a guarantee for a sale, and the Rambam does not equate them. The eravon guarantees the whole sale like R Yochanan said in Bava Metzia 48. A mashkon is for a loan or other obligations. There the mashkon guarantees just the amount parallel to its worth (as per Laws of Loans chapter 13 law 4)---------------------I see in the אבי עזרי of רב שך that he equates משכון and עירבון, and he has good reason to do so since the גמרא itself (בבא מציעא מ''ח ע''ב) asks from one to the other and that implies that they are the same. It is rather like a kinyan sudar that causes a sale to be final, even though the sale might be worth millions while the handkerchief is worth two cents.------------------------I think here is a good place to say what רב שך says. He says that עירבון and משכון are equal in so far as their value is weighed equal to the value of the loan or the sale, [in the approach of the רמב''ן]. Also, in terms of a sale, no one thinks that to receive a partial amount by the giving of some object, that if that object is lost the whole sale goes to the buyer. That was not up for discussion in the first place.-----So רב שך equates משכון and עירבון in so far as they cause the exchange, (the loan or the sale), to be valid. But if lost, they are evaluated only according to their monetary worth. תהיתי מדוע הרי"ף והרמב"ם מתעלמים מההבדלים הנזכרים בגמרא על משכון. למשל, בבא מציעא סביב עמוד פ''ב הגמרא מביא את המשנה שאומרת שמלווה עם המשכון הוא שומר בתשלום (שומר שכר) . הגמרא שואל אם זה אולי לא כמו ר' אליעזר שאומר שהוא שומר ללא תשלום (שומר חינם). הגמרא מציע שאולי הם חלוקים בדין של ר' יצחק שאומר שמי שמלווה לאחר עם משכון הוא הבעלים של המשכון. תְשׁוּבָה. ר' יצחק מתייחס למועד שלקח את המשכון במועד שונה מהזמן שבו נתן את ההלוואה. Bava Metzia around page 82, Pesachim page 31b

I have wondered why the Rif and Rambam ignore the differences mentioned in the Gemara about a pledge. For example, in Bava Metzia around page 82 the Gemara brings the Mishna that says a lender with the pledge is a paid guard. It asks if that is perhaps not like R Eliezer who says he is an unpaid guard. The Gemara suggests perhaps they are disagreeing about the law of R Isaac who says one who lends to another with a pledge owns the pledge. Answer. R Isaac refers to when he took the pledge at a different time than the time when he made the loan. [you can understand this like Tosphot who says R Isaac means he is a paid guard, and that refers to when he took the pledge at a different time than the time of the loan. You can also understand this like Rashi that R Isaac means he is a borrower if he took the pledge at a different time than the time of the loan.] The Rif however understands R Isaac to mean the lender is a paid guard and it makes not difference when he received the pledge. I think the Rif is based on the Gemara in Pesachim page 31b which bring a teaching that says if a Israeli loaned money to a gentile and received leavened bread as a pledge and it remained in his domain during Passover, he does not transgress any prohibition. However, R Meir said he does transgress. Thus, the Rif simply decided the law like the first Tana teacher (the first opinion in the braita). (That does seem not to be like R Isaac. To R Isaac the Israeli ought to be considered to transgress.) It is however unclear to me why the Rif did not say the argument between the first tana and R Meir when he took the leavened bread at the time of the loan; and R Isaac refers to when he took te bred at a different time.-----------------------------------I have wondered why the רי''ף and רמב''ם ignore the differences mentioned in the גמרא about a משכון. כשחזרתי מהים, עלה בדעתי למה הרמב''ם לא מחזיק בדין ר' יצחק. [ר' יצחק אמר שהמלווה המחזיק בערבות נחשב כבעל המשכון.] הסיבה היא בש''ך בחושן משפט פרק ע''ב הלכה ב'. שם הש''ך מראה שהחזקת המשכון משמעה שהמלווה נחשב לשואל שחייב לשלם אם המשכון אבד, גם אם אבד בנסיבות קיצוניות (אונסים כגון טבעה ספינתו). זו שהוא מראה היא גישתו של רש''י. אולם אנו יודעים שהרמב''ם אינו פוסק כך. אני מניח שהסיבה היא שהמשנה עצמו מביא את דעתו של ר' עקיבא שהמלווה עם המשכון הוא שומר בתשלום, שומר שכר. אם כן, הרמב''ם לא מחזיק כמו רש''י. וכפי שמראה הש''ך, הדרך היחידה להבין את ר' יצחק היא שהמלווה נחשב שואל. אז, הרמב''ם לא מחזיק עם ר' יצחק..----השאלה שאני מתמודד איתה כאן היא שהגמרא נראה שמחזיקה מהדין של ר' יצחק--------- כאן אני רוצה להוסיף כמה מחשבות. האחת היא שכפי שאני רואה את הדברים, הרמב''ם לא החליט כמו ר' יצחק כי המשנה בבא מציעא דף פ''ב אומרת שהמלווה עם המשכון הוא שומר שכר לפי ר' עקיבא, או שומר חינם לפי ר' אליעזר, ולא הכריע כמו שמואל בגלל המשנה בדף מ''ב בשבועות. זה נראה חריג, שהרי הרב''ם אני חושב שבדרך כלל הולך כמו שהגמרא נוטה---[סתמא דגמרא.] וסתמא דגמרא היא למעשה הדרך שבה אמור ללכת הדין, לפי סוגיא של דיין שטעה
