I was at the sea in the morning and on the way back it occurred to me as a possibility of what Rav Shach might be saying about a mashkon guarantee for a loan. for there seem to be two kinds of guarantees for money that is owed. one is a mashkon and the other is an eiravon. the later seems to be related mainly to a sale even though the gemara in Bava Metzia pg 48b seems to want to equate the two of them. A mashkon is famous for meaning a guarantee for a loan. But i would like to mention that an eiravon seems to be an argument. there are three opinions. one is that it is partial payment for a sale. one is that it considered to intend to complete the sale. that is it is money but it is intended to finalize the sale even before the buyer picks up the sold item. one other opinion is that is it the same as a mashkin. this was all a small introduction to what I think Rav Shach might be saying. there is an argument in Shavuot page 43 about a mashkon. R Yochanan says it is for the whole loan. Rav said it is only to pay for its parallel value of the loan. Rav Shach wants to relate this to an argument between the Ramban and Rabainu Nisim bar Reuven] the Rambam says if one has borrowed money and given a guarantee to the lender. if the lender loses the object in a way that he was not responsible, to r yochanan, the lost object is considered to be payment for the loan and the borrower owes nothing. To Rav however it is considered to be payment only parallel to it own value. this is most rishonim explain the argument between R Yochanan and Rav. But the Rambam has a different approach to this. at any rate the Ramban hold that if one has a loan and the object he gave to the lender as a guarantee was lost, the borrower owes nothing until he gets back the objector if it can be proven that the lender was not negligent. R Nisim says if the object is worth less than the loan, the borrower is required to pay back the extra amount even before the object is returned. Rav Shach wants to relate the argument between the Ramban and R Nisim to the argument between R Yohanan and Rav. This seems curious at first sight because the law is like R Yochanan against Rav as a general rule.
