I was thinking about what I wrote in my previous blog about Bava Metzia page 48, and I realized that I really have only one answer there for the Rambam. That is the idea of the Baal Hameeor and the Ramban that the decree that pulling acquires is only for the seller and buyer. The Sages would not have made a decree for a gentile. Therefore, when the Jew pays with money of hekdesh (the Temple) to a gentile (without picking up the bought object) he transgresses meila because the gentile has acquired the money regardless if the Jew has acquired the bought object or not. You do not need the idea of the Maharam of Lublin that the decree of the sages was only that the buyer does not acquire until he picked up the bought object, but that that the seller does not acquire the money. I think that idea does not solve the Rambam in any case, because if it would be so, then what about the case when the Jew buys from another Jew? There the law is that he does not transgress meila unless he picks up the object. הרמב"ם כתב שכאשר יהודי קונה מגוי (מבלי לקחת את החפץ), ומשלם בכסף הקדש, היהודי עובר על מעילה, (באמצעות כסף המקדש לתועלת חול). I tried to understand what Rav Shach and Reb Aaron Kotler are saying about the subject in Bava Metzia page 48. I cannot say I understand either. However, on the way back from the sea, it occurred to me what I think Rav Shach is saying. The Rambam wrote that when a Jew buys from a gentile (without picking up the object), and pays with money of hekdesh, the Jew transgress meila, using money of the temple for secular benefit. But when the Jew buys from another Jew, and pays with money of hekdesh (without picking up the object), he does not transgress meila. Rav Shach asks on this, and I think he is asking that even when the Jew buys from another Jew, he should transgress the prohibition because from the law of the Torah money acquires. Now this is what I think about this. The decision of the Rambam is no problem because it is directly from the gemara in Avoda Zara page 63. If one pays with a sheep to a prostitute that is a gentile, she acquire it even before she picks it up because money acquires, and the sex is in place of the money that pays for the sheep. This can also be considered to come directly from the Gemara in Bava Metzia page 48 because the braita that Rava brings as support to Reish Lakish can easily be thought to refer to a gentile as Tosphot writes there.(Rava is based on how Rav understands the braita, that that it means only paying for entry to a bathhouse with money of hekdesh transgresses meila. However, R Yochanan can say the braita is just one example of the law that money acquires.) The only question is what is the reasoning behind all this. According to the Baal Hameor the law that a Jew acquires by means of pulling is for the benefit of the seller. The Ramban disagrees and hold it is for the benefit of both. But in either case it is for the benefit of the parties involved. Therefore, in the case where a Jew buys an object from a gentile, there is no decree of the sages for the benefit of the gentile. Therefore, he acquires the money that is paid to him immediately even if the Jew does not acquire the object until he picks it up (as the Maharam from Lublin writes in Avoda Zara page 63. Therefore, the Jew transgress meila immediately because the money has gone out of the domain of hekdesh. And even though Rav Shach brings from achronim that the Rambam does not hold with change of domain, still there is plenty of evidence that he does as reb aaron wrote So we now understand the Rambam. When the Jew buys from a gentile, he transgresses meila because the gentile has acquired the money immediately. בבא מציעא מ''ח עבודה זרה ס''ג ע''א בתוספות ורב שך

תוספות (עבודה זרה דף ס''ג)שואל מה ההבדל בין מעילה לאתנן? עבור מעילה יש לנו את דין בבבא מציעא כסף רוכש [אם הוא נתן כסף של הקדש לסיטון, הוא עובר על מעילה], אבל עבור אתנן רק משיכה רוכשת. ציינתי לפני כן שלרמב"ם אין זו שאלה. כאשר מדובר בגוי, כסף רוכש, ואותם מקרים בבא מציעא מ''ח ע''א מתייחסים לגוי. אבל, תוספות שואלת את זה, ונותנת תשובה שקשה להבין. רב שך זצ''ל משתמש ברעיון של בעל המאור כדי להסביר את התוספות. כשמדובר במעילה, כל מה שאנחנו צריכים הוא שבעל בית המרחץ (בלן) או שהסיטון ירכשו. אבל כדי שהכבשה תהיה אתנן, אנחנו צריכים שתהיה חוסר אפשרות לבטל את העסקה מכיוון שאתנן דורש לא רק רכישה, אלא גם שנתינתה תהיה סופית. [לאחר מעשה המין, חלק זה של העסקה לא יכול להתבטל אבל הוא יכול לשלם בעד זה ולכן הוא יכול לבטל את קניין הכבש.]----------------------------אבל לפי הרמב"ם, ר' יוחנן סבור שצריך רק להפיק תועלת מהקדש כדי לעבור על מעילה, ולכן אין קושיא מן הברייתא. כמו כן, קנייה מגוי עוברת על מעילה משום שהיהודי מפיק תועלת מהקדש, אבל אם הוא קונה מיהודי בלי להרים את החפץ, לא התרחשה מכירה, ולכן אין תועלת כפי שציין האור שמח

Tosphot asks what is the difference between meila and etnan? For meila we have the din in Bava Meztia money acquires [he gave money of hekdesh to a large store he transgresses meila], but for a etnan only pulling acquires. I mentioned beforehand that to the Rambam this is no question. When it comes to a gentile, money acquires, and those cases in Bava Metzia are referring to a gentile. But, Tosphot asks this, and gives an answer that is hard to understand. Rav Shach uses the idea of the Baal HaMeor in order to explain Tosphot. When it comes to meila, all we need is for the bathhouse owner or the retail store to acquire. But for the sheep to be an etnan, we need there to be the impossibility of nullifying the deal since etnan requires not just acquisition, but also that the giving of it should be final. [After the act of sex, that part of the deal cannot be nullified, but he can pay for it, and thus he can nulify the acquisition of the sheep.]]-------------------תוספות (עבודה זרה דף ס''ג)asks what is the difference between מעילה and אתנן? Also, buying from a gentile transgresses because he derives benefit, but if he buys from a Jew without picking up the object, no sale has gone through, and so there is no benefit as the Or Sameach pointed out.------------------But according to the רמב''ם, ר' יוחנן holds one needs only to derive benefit from the הקדש in order to transgresses מעילה, therefore that ברייתא is no question. Also, buying from a gentile transgresses because he derives benefit, but if he buys from a Jew without picking up the object, no sale has gone through, and so there is no benefit as the אור שמח pointed out.

Just for background information. The Rambam decided that a gentile can acquire by means of picking up or by money. Picking up comes from the gemara in Avoda Zara page 71a where Ameimar said a gentile acquires by pulling. [This is against Rav Ashi there.] The Rambam also decided like the gemara Avoda Zara page 63 where giving a sheep to a gentile prostitute it becomes the payment of a prostitute. [The sheep is used as money to pay for the sex.] See the Gra in Shulchan Aruch Choshen Mishpat chapter 194, Paragraph 10 in the notes of the Gra.] רק למידע רקע. הרמב''ם החליט שגוי יכול לרכוש באמצעות משיכה או על ידי מעות. דין משיכה בא מהגמרא ע''ז דף ע''א ע''א שם אמימר אמר נכרי רוכש במשיכה.
